Terms of Service
Effective date: December 1, 2025
These Terms of Service ("Terms") govern your access to and use of AnchorPoint Virtual Health's health benefits portal and related services. By using the services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.
1. Eligibility & Accounts
You must be authorized by your employer or plan sponsor to enroll or view benefits. You represent that you are of legal age to contract and that you will only create one account for yourself. You agree to provide accurate, current, and complete information during enrollment and to update it promptly when it changes.
You must keep your credentials confidential, use strong passwords, and log out from shared devices. You are responsible for all activity under your account, including actions taken by anyone using your credentials. Notify AnchorPoint Virtual Health and your employer immediately if you suspect unauthorized access.
2. Plan Information & No Advice
Plan summaries shown in the portal are for convenience and may not include exclusions, limitations, waiting periods, network requirements, prior authorization rules, or coordination of benefits provisions. The official plan documents, Summary Plan Description (SPD), and carrier policies control if there is any conflict with information shown here.
The services do not provide medical, tax, financial, or legal advice. Decisions about coverage, dependents, contributions, or providers should be made with your HR team, tax advisor, and licensed professionals. You remain responsible for verifying provider network status, coverage limits, and out-of-pocket obligations before obtaining care.
3. Contributions & Payments
Displayed payroll deductions, employer contributions, surcharges, credits, or wellness rewards are estimates and may change based on eligibility, coverage tier, mid-year life events, tobacco or wellness surcharges, and plan-year rate updates. Final amounts are determined by your employer, carrier, and plan documents.
You authorize required payroll deductions for elected coverage. Missed or insufficient payrolls may result in catch-up deductions or coverage interruption consistent with plan terms and applicable law.
4. Acceptable Use
- Do not upload or transmit malware, exploits, or unauthorized automated traffic.
- Do not attempt to probe, scan, or test the vulnerability of the services or bypass security controls.
- Do not attempt to access, download, or modify data that is not yours or that you are not authorized to view.
- Do not interfere with or disrupt the security, integrity, availability, or performance of the services.
- Do not use the services to harass, discriminate, or violate applicable law, contractual obligations, or third-party rights.
5. Privacy & Data
We collect and process personal and benefits-related information as described in our Privacy Policy, including identifiers, employment details, enrollment choices, and dependent information. For protected health information, we comply with applicable privacy and security requirements and restrict use to benefits administration purposes.
Do not submit sensitive information that is not requested (such as full medical records or unrelated financial data). Data may be shared with carriers, payroll, or administrators as needed to deliver the services.
6. Security
We implement administrative, technical, and physical safeguards (including access controls, encryption in transit where applicable, and monitoring) to protect the services, but no system is fully secure. You are responsible for endpoint security on devices you use to access the portal.
Notify AnchorPoint Virtual Health and your employer promptly of any suspected unauthorized access, credential compromise, or security incident involving the services.
7. Third Parties
The services may link to carrier portals, wellness vendors, payroll systems, or other third parties. Those sites are governed by their own terms and privacy policies. AnchorPoint Virtual Health is not responsible for third-party content, availability, or security. Use third-party services at your own risk.
8. Service Changes
We may update, suspend, or discontinue features (such as plan comparison, document downloads, or messaging) at any time. Where practical, we will provide notice of material changes that impact your use of the services, but availability and uptime are not guaranteed.
9. Disclaimers
The services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Plan information, network status, and rates are subject to change and may be updated by carriers or employers without notice. Access to the services may be interrupted for maintenance or factors beyond our control.
10. Limitation of Liability
To the maximum extent permitted by law, AnchorPoint Virtual Health and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenues, data, or goodwill arising from or related to your use of the services. Our aggregate liability will not exceed the greater of (a) the amount you paid for access to the services in the 12 months preceding the claim, or (b) $100. Some jurisdictions do not allow certain limitations, so these limits may not apply to you to the extent prohibited by law.
11. Indemnification
You agree to indemnify and hold harmless AnchorPoint Virtual Health, its affiliates, and their personnel from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the services, violation of these Terms, or violation of applicable law or third-party rights. We will provide notice of any indemnified claim and you will cooperate in the defense.
12. Governing Law
These Terms are governed by the laws of the jurisdiction where AnchorPoint Virtual Health is organized, excluding its conflict of law rules, unless a different governing law is required by applicable benefits regulations.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the portal or by email. Your continued use after changes take effect constitutes acceptance.
